M\u00fcmtaz Uzun selamlama konu\u015fmas\u0131 yapt\u0131. Belediyelerin kamu kayna\u011f\u0131 alan hizmet kurulu\u015flar\u0131 oldu\u011funu s\u00f6yleyen Av. M\u00fcmtaz Uzun bu anlamda belediyelerin g\u00f6revlerinin yasalarca belirtilmi\u015f oldu\u011funu s\u00f6yledi. Genel Sekreterimiz Av. M\u00fcmtaz Uzun s\u00f6zlerine \u015f\u00f6yle devam etti:<\/p>\n<p style=\"text-align: justify;\">\u201cBelediyelerin g\u00f6rev alanlar\u0131 yasalarla s\u0131n\u0131rlanm\u0131\u015ft\u0131r. Hi\u00e7 kimse yasalardan almad\u0131\u011f\u0131 bir yetkiyi kullanamaz. Devlet bu anlay\u0131\u015fla denetim, kontrol ve takip mekanizmas\u0131n\u0131 olu\u015fturmu\u015ftur. Bunlar\u0131n ba\u015f\u0131nda da Say\u0131\u015ftay vard\u0131r. Say\u0131\u015ftay Anayasa, y\u00fcksek yarg\u0131 organlar\u0131 i\u00e7erisinde yer alm\u0131\u015f ve kamu kurumlar\u0131n\u0131n gelir gider ve mal al\u0131m\u0131n\u0131 takip ve kontrol etmektedir.<\/p>\n<p style=\"text-align: justify;\">\u015eay\u0131\u015ftay\u2019\u0131n kurumlar\u0131n hesaplar\u0131n\u0131 yarg\u0131lamada, kamu zarar\u0131 olup olmad\u0131\u011f\u0131n\u0131 kontrol etmekle ve kamu zarar\u0131 s\u00f6z konusu ise ilgili ki\u015filere zimmet \u00e7\u0131karmakla g\u00f6revli oldu\u011funu hepimiz bilmekteyiz. Biz de bu programda kar\u015f\u0131la\u015ft\u0131\u011f\u0131m\u0131z sorunlar\u0131n a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 amac\u0131yla siz de\u011ferli belediye \u00e7al\u0131\u015fanlar\u0131m\u0131za Say\u0131\u015ftay denet\u00e7ilerini getirdik. Bu anlamda 19. Denetim Grubunda g\u00f6rev uzmanlar\u0131m\u0131zdan Sezgin \u00dc\u011fl\u00fc, Abd\u00fclkadir Dereli ve Bora Taber beye yapacaklar\u0131 katk\u0131lar\u0131ndan dolay\u0131 \u015fimdiden te\u015fekk\u00fcr ederim.<\/p>\n<p style=\"text-align: justify;\">Bir musibet bin nasihatin evlad\u0131r derler. Biz bu e\u011fitim programlar\u0131 ile bin nasihatin yan\u0131na bir nasihat daha ekleyelim ve o musibetlere d\u00fc\u015fmekten kendimizi korumu\u015f olal\u0131m. Denetim Grubunda g\u00f6revli uzmanlardan Abd\u00fclkadir Dere taraf\u0131ndan Belediye \u015eirketlerinin Denetimi ba\u015fl\u0131kl\u0131 bir sunum ger\u00e7ekle\u015fti. Belediyelerin \u015eirket Kurma Nedenleri ba\u015fl\u0131\u011f\u0131 il a\u00e7\u0131lan sunumda mahalli idarelerin \u015firketle\u015fme tarihlerinin olduk\u00e7a eski oldu\u011funa dikkat \u00e7eken Dere; \u015firket kurma giri\u015fimlerinin 1980 y\u0131l\u0131ndan itibaren h\u0131z kazand\u0131\u011f\u0131 s\u00f6yledi. Abd\u00fclkadir Dere s\u00f6zlerine \u015f\u00f6yle devam etti;<\/p>\n<p style=\"text-align: justify;\">\u201cBu \u015firketler ba\u015flang\u0131\u00e7ta iyi niyetle ula\u015fmak istedikleri hedefleri ger\u00e7ekle\u015ftirmek i\u00e7in kurulsa da g\u00fcn\u00fcm\u00fczde \u015firket kurma ad\u0131 alt\u0131nda ba\u015fka ama\u00e7lar oldu\u011fu ortadad\u0131r. Bu ama\u00e7lar ise merkezi y\u00f6netimin vesayet yetkisinden ve denetiminden kurtulmak ve mali a\u00e7\u0131dan \u00f6zerkli\u011fi artt\u0131rmak, personel temini ve istihdam\u0131nda daha serbest hareket etme olana\u011f\u0131 elde etmek ba\u015fl\u0131klar alt\u0131nda \u00f6zetlenebilir.\u201d<\/p>\n<p style=\"text-align: justify;\">Daha sonra ise 5216 Say\u0131l\u0131 Kanun kapsam\u0131nda b\u00fcy\u00fck\u015fehir belediyelerinin \u015firket kurmas\u0131 konusuna ge\u00e7ildi. Bu kapsamda 6102 Say\u0131l\u0131 T\u00fcrk Ticaret Kanunu, Belediye \u0130\u015fletmeleri, Belediye \u015eirketlerinin Denetimi, \u015eirketlerin Belediyece Denetimi, \u015eirketlerde Say\u0131\u015ftay Denetimi, Say\u0131\u015ftay Denetiminde \u0130stenen Bilgiler, Kamu Haznedarl\u0131\u011f\u0131 Tebli\u011fi, Belediye \u015eirketlerinin Say\u0131\u015ftay Ba\u015fkanl\u0131\u011f\u0131na Mutat Olarak Sunmas\u0131 Gerekli Evraklar, Belediye \u015eirketlerinde Gerekli Mali Evraklar\u0131 Haz\u0131rlamakla Sorumlu Olanlar\u0131n kimler oldu\u011fu, Belediye \u015firketleri ihalelere kat\u0131l\u0131p kat\u0131lamayaca\u011f\u0131 ba\u015fl\u0131klar\u0131 kapsam\u0131nda yakla\u015f\u0131k iki saat seminer verildi.<\/p>\n<p style=\"text-align:
